   This website is operated by Ionizers LLC, doing business as Life Ionizers™ ("Ionizers LLC", "Life Ionizers", "we", "us" and "our"). Ionizers LLC offers this website, including all information, tools, products and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies and notices stated here.
   
   By visiting our site, purchasing something from us, or subscribing to our email or text message communications, you engage in our "Service" and agree to be bound by the following terms and conditions ("Terms of Service", "Terms"), including the additional terms and policies referenced here or available by hyperlink, including our Privacy Policy and our Warranty & Return Policy. These Terms apply to all users of the site, including browsers, customers, merchants, and contributors of content.

   Our water ionizers, filtration systems and related products are consumer and commercial water treatment appliances. They are not medical devices, and we do not claim that they diagnose, treat, cure, mitigate or prevent any disease or medical condition. Statements on this site, in our marketing communications, and in any studies, articles, videos or testimonials we share have not been evaluated by the U.S. Food and Drug Administration.
   
   Information on this site is for educational purposes only and is not medical advice. Consult a qualified healthcare professional before making changes to your diet, hydration or health routine, particularly if you are pregnant, nursing, have a medical condition, or take medication.
   
   Testimonials and reviews reflect the individual experiences of the people who submitted them. Individual results vary and are not guaranteed. Where a reviewer received a free product, discount or other benefit, or is otherwise connected to us, we disclose that connection as required by law.
   
   Product performance, water output, pH ranges and filter life depend on your source water quality, usage, installation and maintenance. You are responsible for having your product installed and maintained in accordance with the manufacturer's instructions and applicable plumbing, electrical and building codes, and we recommend using a licensed professional where required.
   
   
6. Modifications to the Service and Prices
   
   Prices for our products are subject to change without notice. We may modify or discontinue the Service (or any part of it) at any time. We are not liable to you or any third party for any modification, price change, suspension or discontinuance of the Service, except as required by law.
   
   
7. Products, Orders, Payment and Shipping
   
   Certain products may be available exclusively online and in limited quantities. Returns, exchanges and warranty claims are governed by our Warranty & Return Policy.
   
   We display product colors and images as accurately as possible but cannot guarantee that your screen's display of any color will be accurate. We may limit sales of our products to any person, geographic region or jurisdiction, and may limit quantities. All product descriptions and pricing are subject to change at any time. Any offer made on this site is void where prohibited.
   
   Prices are listed in U.S. dollars. You agree to pay all charges for your order, including applicable taxes, shipping and handling, at the prices in effect when the order is placed. By submitting an order you authorize us and our payment processors to charge your selected payment method. If financing is offered through a third-party provider, your use of that financing is subject to that provider's separate terms, and we are not the lender.
   
   We may refuse or cancel any order, and may limit or cancel quantities purchased per person, per household or per order, including orders placed under the same account, payment card, or billing or shipping address. If we change or cancel an order, we will attempt to notify you using the email, phone number or billing address provided. We may limit or prohibit orders that appear, in our reasonable judgment, to be placed by dealers, resellers or distributors, unless made under a separate written agreement with us.
   
   You agree to provide current, complete and accurate purchase and account information and to promptly update it so that we can complete your transactions and contact you as needed.
   
   
8. Accounts
   
   If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
   
   
9. Email and Text Message Marketing
   
   Email. When you subscribe to our newsletter, sign up through a form on our site, or opt in during checkout, you consent to receive marketing emails from Ionizers LLC, including offers, product news, educational content and event announcements. Message frequency varies. Every marketing email includes a working unsubscribe link and our physical mailing address, and we honor unsubscribe requests promptly and in any event within ten (10) business days. You may also unsubscribe at any time by emailing [YOUR EMAIL ADDRESS]. Consent to marketing email is not a condition of purchase. If you are located in the European Economic Area, United Kingdom or another region that requires it, we will only send marketing emails where you have given consent or another lawful basis applies.
   
   Transactional messages. Even if you unsubscribe from marketing, we may still send you non-promotional messages about your orders, shipping, warranty registration, account and customer service.
   
   Text messages (SMS/MMS). If you opt in to receive text messages from us, you agree to receive recurring automated marketing and informational text messages (such as promotions, offers and order-related updates) from Ionizers LLC at the mobile number you provided. Consent to receive texts is not a condition of any purchase. Message frequency varies. Message and data rates may apply. Reply STOP at any time to cancel and HELP for help; you may also contact us at 800-323-3137 or [YOUR EMAIL ADDRESS]. After you send STOP, we will send one final message confirming your opt-out. Carriers are not liable for delayed or undelivered messages. No mobile information will be shared with third parties or affiliates for marketing or promotional purposes.
   
   Service providers and tracking. We use ActiveCampaign, LLC to manage and send our email and text message communications. ActiveCampaign processes your contact information and engagement data (such as email opens, link clicks and site activity connected to your subscriber profile) on our behalf and under our instructions. We use this information to send relevant messages and measure performance. See our Privacy Policy for details on the information we collect, how it is used and shared, and your privacy rights.
   
   List integrity. We only send marketing messages to people who have opted in or with whom we have an existing customer relationship as permitted by law. We do not purchase or rent email or phone lists. If you believe you received a message from us in error, contact us and we will promptly investigate and correct it.
   
   
10. Electronic Communications and Signatures
    
    By using the Service, placing an order, or contacting us, you consent to receive communications from us electronically, including by email, and you agree that all agreements, notices, disclosures and other communications we provide electronically satisfy any legal requirement that they be in writing.     We may provide access to third-party tools over which we neither monitor nor have any control.     We may, but have no obligation to, monitor, edit or remove content that we determine in our discretion to be unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that violates any party's intellectual property or these Terms. You represent that your comments will not violate any third party's rights, will not contain unlawful, abusive or obscene material or malware, and will be truthful. You may not use a false email address or impersonate anyone. You are solely responsible for your comments.

    All content on this site, including text, graphics, logos, product images, videos, software and the names Life Ionizers™ and Ionizers, is owned by or licensed to Ionizers LLC and protected by copyright, trademark and other laws. You may not use our marks or content without our prior written permission, except for personal, non-commercial use of content for its intended purpose.

    Your submission of personal information through the store is governed by our Privacy Policy, which explains what we collect, how we use it, who we share it with (including our service providers such as Shopify, our payment processors, and ActiveCampaign), and how you can access, correct, delete or opt out of certain uses of your information.
    
    
15. Errors, Inaccuracies and Omissions
    
    Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions relating to product descriptions, pricing, promotions, offers, shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information is inaccurate, at any time and without prior notice (including after you have submitted your order). If we cancel an order that has already been paid for, we will refund the amount paid.

17. Disclaimer of Warranties and Limitation of Liability
    
    We do not guarantee that your use of our Service will be uninterrupted, timely, secure or error-free, or that results obtained from the Service will be accurate or reliable. We may remove the Service for indefinite periods or cancel the Service at any time without notice.
    
    Except as expressly stated in our Warranty & Return Policy or required by law, your use of, or inability to use, the Service is at your sole risk, and the Service and all products delivered through it are provided "as is" and "as available," without representations, warranties or conditions of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title and non-infringement.
    
    To the fullest extent permitted by law, Ionizers LLC and its members, managers, officers, employees, affiliates, agents, contractors, suppliers, service providers and licensors will not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special or consequential damages of any kind, including lost profits, lost revenue, lost savings, loss of data or replacement costs, whether in contract, tort (including negligence), strict liability or otherwise, arising from your use of the Service or any products purchased through it, even if advised of the possibility. Some states do not allow certain limitations of liability, so in those states our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits any warranty or right you have under applicable law that cannot be waived, or our express written warranty under the Warranty & Return Policy.
    
    
18. Indemnification
    
    You agree to indemnify, defend and hold harmless Ionizers LLC and its members, managers, affiliates, officers, employees, agents, contractors, licensors, suppliers and service providers from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms or the documents they incorporate by reference, or your violation of any law or the rights of a third party.
    
    
19. Dispute Resolution and Arbitration
    
    Informal resolution. Before filing any claim, you agree to contact us at brian@lifeionizers.com and give us at least 30 days to try to resolve the dispute informally.
    
    Binding arbitration. If a dispute is not resolved informally, you and Ionizers LLC agree that any dispute arising out of or relating to these Terms or the Service will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either party may bring an individual claim in small claims court and either party may seek injunctive relief in court for intellectual property claims. The arbitration will be held in [COUNTY, STATE] or remotely, and the arbitrator may award the same individual relief a court could.
    
    Class action waiver. To the fullest extent permitted by law, all claims must be brought in your individual capacity and not as a plaintiff or class member in any class, collective or representative proceeding.
    
    Opt-out. You may opt out of this arbitration provision by emailing brian@lifeionizers.com within 30 days of first accepting these Terms, stating your name and that you opt out of arbitration.
    
    
20. Severability
    
    If any provision of these Terms is determined to be unlawful, void or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the unenforceable portion will be severed without affecting the validity of the remaining provisions.
    
    
21. Termination
    
    These Terms are effective unless and until terminated by you or us. You may terminate them at any time by notifying us that you no longer wish to use our Service or by ceasing to use our site. If we determine, in our reasonable judgment, that you have failed to comply with these Terms, we may terminate this agreement or deny you access to the Service at any time, and you remain liable for all amounts due up to the date of termination. Obligations and liabilities incurred before termination, and provisions that by their nature should survive (including Sections 13, 17, 18 and 19), survive termination.

    Our failure to exercise or enforce any right or provision of these Terms is not a waiver of that right or provision.
